Yes. You can release music independently using WAVS samples, as long as the sample is only used as part of a finished song (your “Licensee’s Music”) and you do not redistribute the sample on its own.
What is allowed
- Releasing songs on DSPs (Spotify, Apple Music, YouTube, etc.) that include WAVS samples.
- Commercial or non-commercial releases, as long as the sample remains embedded in your finished song.
What is not allowed
- Reselling, redistributing, or repackaging any WAVS sample as a standalone sample, loop, stem pack, sound library, or similar.
- Using WAVS samples for AI training.
When “Royalty License” obligations can kick in
Some samples on WAVS are Royalty-Free, and some are Royalty Licenses. If your track uses a Royalty License sample, extra obligations can be triggered if any of the following happens:
- Your track is released or distributed by a major label (or its affiliates), or
- Your track exceeds 1,000,000 cumulative streams across Spotify, Apple Music, or YouTube (and similar DSPs WAVS may add), or
- Your track is licensed for sync (film, TV, ads, games, etc.).
When triggered, you must follow the Royalty License requirements (credits, splits, and payments) defined in the Terms.
